When will ENS requirements for EU imports into Great Britain take effect?

The requirement for ENS declarations on goods imported from the EU into Great Britain will commence on 31 January 2025. Businesses are encouraged to prepare in advance to ensure compliance by this date.

Who is responsible for submitting the ENS declaration?

The legal responsibility to submit an ENS declaration lies with the carrier—the operator of the active means of transport bringing the goods into the UK. However, a third party, such as an importer or intermediary, can submit the declaration on the carrier’s behalf with the carrier’s knowledge and consent. The carrier remains liable for ensuring the declaration is submitted on time.

What information is required in an ENS declaration?

The ENS declaration requires specific data elements, including:

  • Consignor and Consignee Details: Names and addresses, and EORI numbers if available.
  • Goods Description: Detailed description or commodity code.
  • Transport Information: Mode of transport, journey route, and expected arrival date and time.
  • Packaging Details: Number and type of packages, total weight.

From 31 January 2025, the dataset will include 20 mandatory fields, 8 conditional fields (required in specific circumstances), and 9 optional fields.

How and when should the ENS declaration be submitted?

ENS declarations must be submitted electronically through the Safety and Security Great Britain (S&S GB) service. The timing depends on the mode of transport:

  • Maritime Containerised Cargo: At least 24 hours before loading at the port of departure.
  • Maritime Bulk or Break Bulk Cargo: At least 4 hours before arrival.
  • Roll-on Roll-off (RoRo) Accompanied Freight: At least 2 hours before arrival of the ferry operator.
  • Short-Haul Flights (less than 4 hours): At the time of actual take-off.
  • Long-Haul Flights: At least 4 hours before arrival.

Are there any exemptions to the ENS requirement?

Certain goods are exempt from ENS requirements, including:

  • Electrical energy.
  • Goods entering by pipeline.
  • Letters, postcards, and printed materials.
  • Goods in a traveller’s personal luggage declared to customs orally.

A detailed list of exemptions is available in Article 104 of the retained Commission Delegated Regulation (EU) 2015/2446.

What are the consequences of failing to submit an ENS declaration?

Non-compliance with ENS requirements can lead to:

However, submitted declarations cannot be cancelled; if goods will no longer be shipped, it is not necessary to inform the S&S GB service.

To register for the S&S GB service, you will need:

  • A Government Gateway account.
  • A Great Britain Economic Operators Registration and Identification (EORI) number.

The S&S GB service does not have a user interface; therefore, data will need to be lodged using Customs Declarations UK platform.
